3. CHANGES TO THESE TERMS
VEVER may amend these Terms of Use, in particular to reflect changes to the Site, its services, its practices or applicable regulations.
The version in force is the one published on the Site on the date you access it.
Changes apply to any use of the Site after they are published online.
4. ACCESS TO THE SITE
VEVER endeavours to ensure that the Site is accessible and functions properly.
Access to the Site may nevertheless be temporarily interrupted or limited, particularly due to:
- maintenance operations;
- updates;
- technical incidents;
- measures intended to ensure the security of the Site;
- circumstances beyond VEVER’s control;
- or any event requiring the temporary suspension of a feature.
VEVER does not guarantee uninterrupted or error-free access to the Site.
To the fullest extent permitted by applicable regulations, VEVER shall not be held liable for the consequences of temporary unavailability of the Site, particularly where this results from maintenance, a technical issue beyond its control or an event of force majeure.
5. INFORMATION PRESENTED ON THE SITE
VEVER takes the utmost care with the information, texts, photographs and depictions of its creations available on the Site.
We endeavour to keep this information accurate and up to date.
However, there may be differences between the appearance of a product on screen and its actual appearance, particularly due to:
- photographic conditions;
- how colours are displayed on different screens and devices;
- brightness settings;
- screen size;
- or the handcrafted nature of certain creations.
The photographs and depictions available on the Site are therefore for illustrative purposes and cannot perfectly reproduce the appearance of a piece of jewellery, its materials or its stones.
The essential characteristics of products offered for sale are specified on the product pages and in the information provided to the Customer before placing an order.
In the event of any conflict concerning the terms of purchase of a product, the General Terms and Conditions of Sale applicable to the order take precedence over these Terms of Use.
6. USE OF THE SITE
You agree to use the Site in good faith, for its intended purpose and in compliance with applicable law.
In particular, it is prohibited:
- to use the Site for unlawful or fraudulent purposes;
- to attempt to gain unauthorised access to computer systems, servers, accounts or data associated with the Site;
- to disrupt or attempt to disrupt the operation or security of the Site;
- to introduce viruses, malware, code or devices that may harm the Site or its users;
- to use a third party’s identity without their authorisation;
- to collect or extract data from the Site on a large scale outside uses authorised by VEVER or by law;
- to use automated processes to circumvent the technical measures put in place by VEVER;
- to use the Site or its content in a manner that may infringe the rights of VEVER or third parties.
VEVER may take any measures reasonably necessary to preserve the security and integrity of the Site.
7. INTELLECTUAL PROPERTY
The Site and all elements that comprise it or are accessible through it may be protected by intellectual property rights.
This includes, in particular, without limitation:
- the name VEVER;
- the Maison’s trademarks, logos and distinctive signs;
- jewellery creations and their designs;
- designs;
- sketches and illustrations;
- archives;
- photographs and videos;
- texts;
- graphic elements;
- animations;
- editorial content;
- the Site’s layout and design;
- as well as any other content created by or for VEVER.
These elements belong to VEVER or are used with the authorisation of their respective rights holders.
No rights in these elements are transferred to users merely by virtue of their access to the Site.
Without VEVER’s prior written authorisation or an exception expressly provided by law, it is prohibited to reproduce, display, copy, modify, adapt, distribute, publish, disseminate, commercialise, extract or reuse all or part of the Site’s content.
You may, however, browse the Site and make copies or printouts strictly necessary for your personal and private use, within the limits permitted by applicable law.
Any commercial or promotional use of VEVER’s content requires the Maison’s prior written authorisation.
8. TEXT AND DATA MINING – USE BY AUTOMATED SYSTEMS
Subject to exceptions that cannot legally be waived, VEVER expressly objects to the use of protected content available on the Site for text and data mining purposes, within the meaning of the applicable regulations.
This objection applies in particular to any automated extraction, copying or reproduction of photographs, drawings, texts, descriptions, archives, creations, data or other protected content from the Site for purposes including:
- to train or develop artificial intelligence models;
- to improve or enhance artificial intelligence systems;
- to create datasets;
- to supply generative systems with content;
- or to engage in any other automated use for commercial purposes.
Any such use requires VEVER’s prior written consent, except where it falls within a mandatory statutory exception.
This objection constitutes, in particular, a reservation of rights under the provisions applicable to text and data mining.
9. TRADEMARKS AND DISTINCTIVE SIGNS
The trademarks, logos, trade names, domain names, distinctive signs and other elements identifying VEVER or its creations are protected by applicable law.
Nothing in these Terms of Use shall be construed as granting a licence or right to use these elements.
Any use, reproduction or imitation likely to cause confusion, take unfair advantage of VEVER’s reputation or infringe the Maison’s rights is prohibited under the conditions provided by law.
10. UNSOLICITED COMMUNICATIONS AND PROPOSALS
You may send messages, comments, suggestions or other communications to VEVER.
Any personal data contained in these communications is processed in accordance with our Privacy Policy.
VEVER asks that you do not submit confidential creations, concepts, drawings or creative proposals unsolicited without the Maison’s prior agreement.
VEVER continually develops its own creations and may be working on concepts similar or identical to ideas submitted to it unsolicited.
Submitting an unsolicited proposal therefore does not oblige VEVER to review or use it, respond to it or enter into a commercial relationship with its author.
However, this provision does not transfer to VEVER any intellectual property rights belonging to the author of the proposal.
11. LINKS TO THIRD-PARTY SITES
The Site may contain links to websites, social networks, services or platforms operated by third parties.
These services are independent of VEVER and are subject to their own terms of use, privacy policies and practices.
VEVER does not systematically monitor their content and cannot be held liable for their availability, security or the information published on them, except where applicable regulations provide for specific liability.
The presence of a link on the Site does not necessarily mean that VEVER endorses or recommends the site or service concerned, or has a commercial relationship with it.
12. LINKS TO THE VEVER SITE
Creating a simple link to a public page of the Site is permitted provided that:
- it does not infringe VEVER’s rights or harm its image;
- it does not create any confusion as to whether VEVER is a partner, affiliate or sponsor;
- and that it does not present the Site’s content in a misleading manner.
The use of framing techniques, the integration of the Site or its content into another website, or any use of VEVER’s trademarks or visual elements to present a link requires VEVER’s prior written authorisation.
VEVER may request the removal of a link if it infringes its rights or legitimate interests.
13. LIABILITY
VEVER endeavours to provide a reliable, secure Site containing accurate information.
However, subject to applicable mandatory legal provisions, VEVER does not guarantee:
- that the Site will be available at all times;
- that its operation will be entirely free from errors;
- that all information will be complete or fully up to date at all times;
- or that use of the Site will be compatible with all existing equipment, systems or software.
Users remain responsible for their computer equipment, internet connection and the reasonable measures necessary to protect their devices and data.
VEVER shall not be held liable for damage arising directly from use of the Site in breach of these Terms, the fault of the user, the actions of a third party or an event constituting force majeure.
Nothing in these Terms is intended to limit or exclude any liability that cannot legally be limited or excluded.
These provisions concern the use of the Site. Liability relating to products purchased from VEVER is governed by the General Terms and Conditions of Sale and applicable statutory warranties.
14. PERSONAL DATA AND COOKIES
When you use the Site, VEVER may process certain personal data.
The conditions under which this data is collected, used, stored and protected, as well as your rights, are described in our Privacy Policy.
The use of cookies and similar technologies is described in our Cookie Policy, which also provides information on managing your preferences.
15. SUSPENSION OR RESTRICTION OF ACCESS
VEVER may take measures to temporarily restrict access to all or part of the Site where reasonably necessary, in particular:
- to ensure the security of the Site;
- to prevent or stop fraudulent or abusive use;
- to protect the rights of VEVER or third parties;
- to carry out maintenance;
- or to comply with a legal or regulatory obligation.
Where a user has an account, VEVER may also suspend or deactivate it in the event of use that is manifestly fraudulent, unlawful or contrary to these Terms, subject to the user’s rights under applicable regulations.
16. SEVERABILITY
If any provision of these Terms of Use is declared void, invalid or unenforceable, the remaining provisions will continue to apply.
The provision concerned would, insofar as possible, be replaced or interpreted in a manner that reflects its original purpose while complying with applicable regulations.
17. NO WAIVER
VEVER’s failure to exercise a right under these Terms of Use at any given time shall not be construed as a waiver of its right to exercise it subsequently.
18. GOVERNING LAW
These Terms of Use are governed by French law.
However, where a user acts as a consumer and resides in another country, the choice of French law does not deprive them of the protection afforded by the mandatory provisions of the law applicable to their circumstances.
Any dispute relating to the use of the Site shall fall within the jurisdiction of the competent courts in accordance with applicable legal rules.
Nothing in these Terms requires a consumer to bring proceedings exclusively before a court located in Paris where the consumer has a legal right to bring proceedings before another court.
