2. SCOPE
These Terms and Conditions of Sale govern sales of VEVER creations (hereinafter the “Products”) concluded with consumers:
- on the website www.vever.com (the “Website”);
- at the VEVER showroom;
- at temporary points of sale operated directly by VEVER;
- at events organised by VEVER;
- and, where VEVER agrees, remotely by telephone, email, instant messaging or any other means of distance communication.
They apply to sales made in France and to international sales in the countries and territories served by VEVER.
These Terms and Conditions of Sale are intended for customers acting as consumers, that is, for purposes outside their trade, business, craft or profession.
Sales to business customers may be subject to separate contractual terms.
By placing an order, the Customer acknowledges that they have read and accepted these Terms and Conditions.
3. CAPACITY TO CONTRACT
To make a purchase from VEVER, the Customer must:
- be an individual;
- have reached the age of legal majority in their country of residence;
- have the legal capacity required to enter into the contract;
- and, where delivery is required, provide an address in a destination served by VEVER.
VEVER may request any documents or information reasonably necessary to verify the Customer’s identity, payment method or the legitimacy of the transaction, in particular for high-value orders or where verification is necessary for security, fraud prevention or compliance with legal obligations.
4. VEVER PRODUCTS
The Products offered for sale are those presented on the Website, in the showroom or in VEVER’s sales materials when the order is placed.
VEVER takes the utmost care in presenting and describing its creations.
Photographs and depictions of the Products are, however, for illustrative purposes. Slight differences in colour, appearance or proportions may result, in particular, from photography conditions, lighting or the settings of the screen used.
As VEVER creations are made using jewellery-making and artisanal techniques, slight variations may also occur between two pieces of the same design.
The weight of the metals and stones, their dimensions and certain other characteristics may vary slightly, in particular due to the size of the piece of jewellery, the nature of the materials or the manufacturing process.
These variations inherent in artisanal production do not constitute a defect, provided they do not alter the essential characteristics of the Product.
The essential characteristics of the Products are stated on their product pages or communicated to the Customer before the order is placed.
5. AVAILABILITY AND MADE-TO-ORDER PRODUCTION
Some VEVER creations are available immediately.
A significant proportion of the creations are, however, made to order.
Unless a different timeframe is stated on the Product page or communicated to the Customer when the order is placed, the usual production time is approximately four (4) weeks.
This timeframe is an estimate. The timeframe applicable to the order is specified or confirmed to the Customer at the time of purchase.
VEVER will inform the Customer as soon as possible of any event likely to have a significant effect on the stated timeframe.
The mere fact that a Product is made after an order is placed does not mean that it is a personalised Product and does not, in itself, deprive the Customer of any right of withdrawal they may have.
6. PERSONALISATION AND ENGRAVING
VEVER offers complimentary personalised engraving on selected creations.
Whether engraving is possible depends on the model concerned.
Unless otherwise stated, the message may contain up to 20 characters and may be engraved in one of the styles offered by VEVER.
The Customer is responsible for any text, initials, date or other details they provide and must carefully check their content before confirmation.
Once the engraving has been completed, it may no longer be possible to change or cancel the personalisation.
Where a Product has been made to the Customer’s specifications or personalised so that it is clearly personal to them, in particular through personalised engraving, it may be excluded from the statutory right of withdrawal in accordance with applicable regulations.
Engraved or specially personalised Products are also excluded from VEVER’s commercial returns policy, unless the Maison exceptionally agrees otherwise.
These exclusions do not affect the statutory guarantees applicable to a defective or non-conforming Product.
7. PRICES AND TAXES
The applicable prices are those stated when the order is placed.
For orders delivered in Europe, prices include all applicable taxes where VAT applies.
For orders delivered outside Europe, prices are charged excluding taxes.
Local taxes, including VAT applicable in the destination country, customs duties, import charges or other levies may be payable when the Product is imported.
These taxes, duties and charges are not included in the price invoiced by VEVER and remain payable by the Customer or recipient.
VEVER has no control over the amount of these taxes and duties or how they are applied. The Customer is advised to consult the relevant authorities in their country before placing an order.
VEVER reserves the right to change its prices at any time. Any change made after an order has been confirmed will not affect the price of that order.
In the event of an obvious pricing error, particularly where a displayed price is plainly unrelated to the value of the Product and can reasonably be identified as incorrect, VEVER may contact the Customer to offer them the choice of proceeding with the order at the correct price or cancelling it with a full refund of any amounts paid.
8. ORDERS
8.1 Orders placed on the Website
The Customer selects the Products they wish to order and adds them to their basket.
Before finally confirming the order, the Customer may review the selected Products, delivery address, delivery method, total price and any applicable charges and taxes, and correct any errors.
Final confirmation of the order entails an obligation to pay.
The Customer then receives order confirmation by email or on another durable medium.
The sale is concluded once VEVER has accepted the order and payment has been confirmed.
8.2 Distance orders placed outside the Website
For orders placed by email, telephone or instant messaging, among other methods, VEVER informs the Customer of the Product’s essential characteristics, its price and the main applicable terms before the sale is concluded.
The order becomes final in accordance with the terms communicated to the Customer, in particular following written acceptance of the quotation or order form and payment of the price or required deposit.
8.3 Showroom purchases
For purchases made in person at the VEVER showroom, the sale is concluded when the parties reach an agreement and payment is made in accordance with the agreed terms.
A purchase concluded entirely in the showroom does not benefit from the statutory right of withdrawal applicable to distance sales.
The Customer nevertheless benefits from VEVER’s commercial returns policy set out in Article 13.
8.4 Sales at events
Where a sale is concluded in circumstances that legally constitute an off-premises contract, the Customer has the mandatory rights provided by applicable law, including the right of withdrawal where provided by law.
9. ACCEPTANCE OR REFUSAL OF AN ORDER
VEVER may refuse or cancel an order for a legitimate reason, in particular in the event of:
- exceptional unavailability of the Product or inability to make it;
- inability to confirm payment;
- manifestly incorrect billing or delivery information;
- reasonable suspicion of fraud or unauthorised use of a payment method;
- an order that is manifestly unusual;
- or an obligation arising from applicable regulations or international sanctions measures.
If payment has already been collected and VEVER cancels the order, the amounts paid will be refunded to the Customer.
10. PAYMENT
The available payment methods are those offered to the Customer when placing the order.
These may include payment by bank card, digital wallet, online payment service or bank transfer.
The price is payable in accordance with the terms stated when the order is placed.
The order may only be dispatched once payment has been confirmed, unless otherwise agreed in writing by VEVER.
Transactions made on the Website are processed by secure payment providers. VEVER does not intend to retain the Customer’s complete bank details.
For certain orders, particularly High Jewellery or high-value orders, VEVER may offer or require payment by bank transfer or a deposit.
11. DELIVERY
VEVER delivers its creations to the destinations offered when the order is placed, subject to any applicable logistical, regulatory or customs restrictions.
The list of destinations served may change.
11.1 Delivery charges
Standard delivery to the address provided by the Customer is complimentary:
- in Europe, for all orders of €1,000 or more;
- for other destinations, on all orders of €3,000 or more.
Where an order does not reach the applicable threshold for complimentary delivery, the delivery charges are shown to the Customer before the order is confirmed.
Any specific terms stated when the order is placed shall take precedence.
11.2 Production and delivery times
For made-to-order creations, the usual production time is approximately four weeks, unless otherwise communicated to the Customer.
Once the piece of jewellery has been received from our workshops and is ready for dispatch, the delivery time is generally approximately:
- 2–3 days in Europe;
- 7 working days for destinations outside Europe.
These transit times are estimates and may vary, in particular, according to the destination, carrier, customs formalities or circumstances beyond VEVER’s control.
The timeframe applicable to the order is specified or confirmed to the Customer.
In the event of a delivery delay, the Customer has the rights provided by applicable law.
11.3 Taxes and formalities for deliveries outside Europe
For orders delivered outside Europe, Products are invoiced exclusive of tax.
Local taxes, including VAT applicable in the destination country, as well as any customs duties, import charges or other levies, may be imposed upon the Product’s arrival.
These amounts:
- are not included in the price invoiced by VEVER;
- are not covered by VEVER;
- and remain payable by the Customer or recipient.
Payment of these amounts may be requested by the carrier, customs authorities or any other competent authority before or upon delivery of the parcel.
11.4 Receipt
The Customer is asked to check the condition of the parcel and the Product as soon as they receive them.
If a parcel is visibly damaged, the Customer is advised to note any appropriate reservations with the carrier and contact VEVER as soon as possible.
This recommendation does not in any way limit the Customer’s statutory guarantees or rights.
11.5 Transfer of risk
Where the Customer acts as a consumer, the risk of loss of or damage to the Product passes to them when they take physical possession of it, or when a third party designated by them, other than the carrier proposed by VEVER, takes possession of it.
12. RIGHT OF WITHDRAWAL FOR DISTANCE SALES
12.1 General principle
Where the Customer has a statutory right of withdrawal, in particular for a distance sale concluded with a consumer in France or the European Union, they have fourteen (14) days from receipt of the Product to inform VEVER of their wish to withdraw, without having to give a reason.
For online orders delivered to a European destination where an equivalent statutory right does not apply, VEVER also offers, as a commercial policy and subject to the exclusions set out below, the option to return the Product within 14 days of receipt.
Where an order contains several Products delivered separately, the period begins upon receipt of the last Product concerned.
12.2 Exercising the right of withdrawal
The Customer may notify VEVER of their decision to withdraw:
- through the withdrawal facility available on the Website;
- by sending a clear statement to contact@vever.com;
- or by using the withdrawal form appended to these Terms and Conditions.
Notification must be sent before the applicable period expires.
For distance contracts concluded through VEVER’s online interface, the Customer is provided with a facility for exercising the right of withdrawal in accordance with applicable regulations.
12.3 Returning the Product
After notifying VEVER of their decision, the Customer must return the Product within the applicable statutory period, following the instructions provided by VEVER.
For eligible orders delivered in Europe, VEVER covers the cost of return shipping when the return is made in accordance with the instructions and using the label or carrier specified by the Maison.
The Product must be returned:
- in a condition that allows it to be resold;
- accompanied by its presentation case;
- with its accessories;
- together with any certificates and documents provided at the time of purchase.
The Customer may handle the Product to the extent necessary to establish its nature and characteristics. However, the Customer may be held liable for any reduction in value resulting from handling beyond what is necessary for that purpose.
12.4 Refunds
Where a return qualifies for a refund, VEVER refunds the relevant amounts in accordance with applicable regulations, generally using the same payment method as that used for the order.
VEVER may withhold the refund until it has received the Product or proof that it has been sent, where permitted by law.
12.5 Personalised Products
In particular, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalised.
This exclusion may apply, in particular, to creations with personalised engraving or alterations specially made at the Customer’s request.
This exclusion does not affect the statutory guarantees applicable if the Product is defective or non-conforming.
12.6 Orders delivered outside Europe
Subject to any mandatory rights applicable to the Customer in their country of residence, VEVER does not offer a commercial returns policy for Products delivered to destinations outside Europe.
This restriction in no way deprives the Customer of statutory warranties or other mandatory rights that they cannot validly waive.
13. SHOWROOM PURCHASES — RETURNS WITHIN 30 DAYS
Independently of any statutory rights that may apply in certain circumstances, VEVER offers a specific commercial policy for Products purchased in its showroom.
An eligible Product may be returned within thirty (30) days of purchase for, at the Customer’s choice:
- an exchange;
- a credit note;
- or a refund.
To qualify under this policy, the Product must:
- not have been worn other than to try it on;
- show no signs of wear, impact, scratches or damage;
- not have been modified or altered by a third party;
- be returned with its presentation case, accessories and any certificates and documents provided at the time of purchase.
Engraved or personalised creations, or creations specially made to the Customer’s specifications, are excluded from this commercial policy unless VEVER expressly agrees otherwise.
VEVER reserves the right to inspect the condition of the Product before approving the return.
This commercial policy does not affect statutory guarantees.
14. STATUTORY GUARANTEES
VEVER Products are covered by the applicable statutory warranties.
For consumers subject to French law, VEVER is, in particular, bound by:
- the statutory guarantee of conformity provided for in Articles L.217-1 et seq. of the French Consumer Code;
- and the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
Statutory guarantee of conformity
The consumer has two years from delivery of the Product to invoke a defect covered by the statutory guarantee of conformity.
Where the conditions of the guarantee are met, the consumer may, in particular, obtain a repair or replacement of the Product under the conditions provided by law.
The Product must be brought into conformity at no cost to the consumer and within the statutory period.
In the circumstances provided for by law, the consumer may also obtain a price reduction or cancellation of the sale.
The statutory guarantee of conformity applies independently of any commercial guarantee VEVER may offer.
Warranty against hidden defects
The consumer also benefits from the warranty against hidden defects where a hidden defect in the Product renders it unfit for its intended use or so substantially impairs that use that the Customer would not have purchased it, or would have paid a lower price for it, had they known of the defect.
A claim arising from hidden defects must be brought within the statutory time limit, in particular within two years of discovering the defect.
Subject to the conditions provided by law, the Customer may return the Product and obtain a refund of the price, or keep the Product and obtain a price reduction.
These statutory rights cannot be excluded or limited by these Terms and Conditions of Sale.
15. AFTER-SALES SERVICE AND REPAIRS
VEVER pays particular attention to the longevity of its creations and offers an after-sales service.
For any maintenance, inspection or repair request, the Customer may contact:
After examining the piece of jewellery, VEVER determines whether the work falls under a statutory guarantee or constitutes maintenance or a repair outside the guarantee.
Where work is not covered by a statutory guarantee, VEVER may provide a quotation, which the Customer must accept before the repair is carried out.
Damage resulting from the following may, in particular, fall outside the scope of a statutory warranty:
- normal wear and tear of the piece of jewellery;
- an impact, a fall or an accident;
- misuse;
- a lack of maintenance;
- improper handling;
- a modification or repair carried out by a person not authorised by VEVER;
- loss of or damage to an item resulting from an external event;
- or use of the Product contrary to its normal intended purpose.
This list cannot exclude a statutory guarantee where its conditions are met.
VEVER recommends entrusting any work on a creation by the Maison to VEVER or a professional expressly authorised by it.
16. RETENTION OF TITLE
The Products remain the property of VEVER until the price has been paid in full.
This retention of title does not affect the rules on the transfer of risk applicable to consumers.
17. LIABILITY
VEVER is responsible for the proper performance of its obligations in accordance with applicable law.
However, VEVER cannot be held liable for damage directly attributable to:
- a fault on the part of the Customer;
- abnormal or inappropriate use of the Product;
- unauthorised work carried out on it;
- or an event constituting force majeure.
Nothing in these Terms and Conditions of Sale is intended to exclude or limit any right or liability that cannot lawfully be excluded or limited in relation to a consumer.
18. FORCE MAJEURE
VEVER cannot be held liable for any delay or failure to perform resulting from an event constituting force majeure under applicable law.
If the impediment is temporary, performance of the obligation concerned may be suspended for the duration of the event.
If the impediment becomes permanent, its consequences for the contract are those provided for by applicable law.
19. PERSONAL DATA
VEVER processes certain personal data to manage orders and its relationships with Customers.
Details of how this data is collected, used, stored and protected, and of the rights of the individuals concerned, are set out in the Privacy Policy available on the Website.
The use of cookies and similar technologies is described in the Cookie Policy.
20. RETENTION OF CONTRACTS AND EVIDENCE
Electronic records retained in the systems of VEVER and its service providers may, to the extent permitted by law, serve as evidence of communications, orders, payments and transactions between VEVER and the Customer.
VEVER retains electronically concluded contracts in the cases and for the periods required by law and allows the Customer to request access to them where provided by law.
21. COMPLAINTS
For any question or complaint concerning an order or a Product, the Customer may contact:
VEVER – Customer Service
9 rue de la Paix
75002 Paris – France
Email: contact@vever.com
Telephone: +33 (0)9 80 76 25 22
VEVER will endeavour to find an amicable solution to any issue brought to its attention.
22. GOVERNING LAW AND DISPUTES
These Terms and Conditions of Sale are governed by French law.
However, where a Customer acting as a consumer resides in another country and benefits from more protective mandatory provisions that cannot be overridden by contract, the choice of French law does not deprive them of that protection.
In the event of a dispute, the Customer is asked to contact VEVER first to seek an amicable solution.
If an amicable resolution cannot be reached, the dispute may be brought before the competent court in accordance with the applicable legal rules.
Nothing in these Terms and Conditions of Sale requires the consumer to bring proceedings exclusively before a court in Paris where mandatory rules on territorial jurisdiction allow them to bring proceedings before another court.
23. AMENDMENTS TO THE TERMS AND CONDITIONS
VEVER may amend these Terms and Conditions of Sale, in particular to reflect changes to its services, business practices or applicable regulations.
The Terms and Conditions applicable to an order are those communicated or made available to the Customer when the contract is concluded.
